Terms of Service

These Terms of Service govern your use of the POPIASafe platform, a POPIA compliance and data privacy solution for organisations subject to POPIA, including those operating in South Africa.

1. Agreement

By accessing or using POPIASafe, you agree to these Terms of Service. If you are using POPIASafe on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

2. Services

POPIASafe provides software features to help organisations manage POPIA compliance, including POPIA consent forms, POPIA record of processing, audit reporting and related workflows. The exact features available depend on your selected plan.

3. Customer data

You retain ownership of the data you store in POPIASafe. You are responsible for ensuring that your use of POPIASafe and the personal information you process complies with POPIA and any other applicable laws. POPIASafe acts as an operator when processing personal information on your behalf.

4. Acceptable use

You agree not to:

  • Use POPIASafe in a way that violates applicable laws or regulations
  • Attempt to gain unauthorised access to the service or related systems
  • Interfere with or disrupt the integrity or performance of the service

5. Fees and payment

If you use a paid plan, you agree to pay the fees set out in the applicable pricing page or order. Fees are generally billed monthly in advance. We may suspend access for non-payment after reasonable notice.

6. Confidentiality

Each party agrees to protect the other party's confidential information and to use it only as necessary to provide or use the services under these terms.

7. Disclaimers

POPIASafe is provided on an "as is" and "as available" basis. While we design POPIASafe to support POPIA compliance, ultimate responsibility for compliance remains with you as the responsible party.

8. Limitation of liability

To the extent permitted by law, POPIASafe's liability is limited to the fees you have paid for the service over the preceding twelve months. We are not liable for indirect or consequential losses.

9. Changes to terms

We may update these Terms of Service periodically. Material changes will be communicated, and continued use of POPIASafe after changes take effect constitutes acceptance.
